Dear Portfolio Committee on Justice and Constitutional Development,
I am an 67 years ( coming Saturday ) and appeared in a Tribunal Hearing on 02 March 2020. The Hearing addressed my decades long "battle" with the dept of labour to reopen my claim with the Compensation fund for labour. The same matter went through the office of the PPSA , Parliaments labour committee , a review meeting with a panel of the provincial legal team ( the chairperson of the legal team disappeared and later told me he took up a post with Correctional Services because his bosses rejected the legal teams recommendation ) - subsequently the Tribunal Hearing.
The Judgement order was that I should undergo a section 42 medical examination for Orthopedic evaluation, to be completed within 60 days from the Hearing.
I was self represented in the hearing. The advocate representing Labour provided me with the referral letter ( for the examination ) 4 months after the Hearing
I was already afraid of the Covid 19 infection as it has already started to increase in our Country SA at the time with two confirmed infections in our house. I did not want to travel from Uitenhage to Port Elizabeth, especially without own transport - I subsequently asked for a postponement.
I have not received a new date since then, despite numerous attempts.I was involve in 2 pre-trials - first at my home and the second in the morning of the Hearing held in a tiny little room. The adv and myself could not really find each other. I am afraid that the advocate seem to delay the process forever.
I am not a very healthy person and would also want to finalize all my outstanding affairs.
Will the Honourable Committee please consider to assist me in undergoing the medical examination which will finalize my longstanding strive for fairness. I thank you - Danie Mars
