The abovementioned case is nearly 14 Years old This IO happened on 20 Aug 2011 It took me 17 months to get this case registered. The claim number was inactive. All medical claims were submitted to my medical aid.
I appointed a lawyer for assistance with the tribunal held on 6 May 2016. The fund accepted full liability for my wife injuries sustained excluding her neck. They claimed that the neck is a re-injured old injury.
In 2006 she had a neck operation. The medical report indicates clearly that the fusion at C5-C7 appears uncomplicated. A new condition between C4-C5 right front where there is Osteophite and Damage to the Neuro Central Joint appeared. It appeared that the doctor failed to understand this. We had to submit a report explaining why the neck should be included. That report was disappeared. We struggled to get any info from Jul 2017 up-to Jan 2021.
We received a unreadable judgment of the tribunal. After Oct 2023 we received an explanation: The complainand failed to submit proof of authorization for the MRI. Authorization was denied on 26 Nov 2013 because the neck wasn’t part of the injuries sustained. The explanation given doesn’t make any sense. The latest is that we failed to submit the MRI report as per the office in Witbank.
Oct 2023: The lawyer applied for an appeal date to appeal on the tribunal judgment. All the places to lodge a complaint were exhausted. I want thank Mr. Francois Bosman from the DG’s office for his assistance. It appears that the fund failed to respond to his repeated requests. What an example of a pathetic service from the fund. Why should Taxpayer’s money be wasted this way?
